Firm Split "To Do" List
1. Write out agreed upon responses to anticipated questions so
that clients receive accurate and consistent information on such
things as how to reach their lawyer, where their file is, or
how they can obtain their file. The fastest way to lose clients
is by publically airing your dirty laundry.
2. Before returning a file or transferring a file, copy all critical
file contents, including work product, for protection from future
malpractice claims or ethical complaints.
3. Inform the court and other parties of the change to include
who will be responsible for the file going forward.
4. Determine how critical data, to include the calendar, client
file material, substantive email, billing, and payment records
from the computer network will be transferred.
5. Address billing and payment of client fees and expenses for
work performed prior to the split but not yet paid and/or work
that is still in progress but not yet billed. Never involve clients
in this firm discussion.
6. Return to the client any advances for expenses not incurred
and any unearned fees.
7. Retain copies of the following documents: the letter
indicating client's choice as to counsel; the record of the
transfer of client file materials; notice of withdrawal or client
dismissal; and signed receipts for file contents and returned
funds.

ANECDOTE
Good fortune: A matter of perspective
It was shaping up to be a bad day for Joe. First, his alarm went off and when he reached for the snooze button, he tumbled out of bed, banged his head, and landed in a heap of tangled sheets on the floor.
He showered and dressed, jumped into his car and turned the ignition. The battery was dead. He called the auto club. His membership had lapsed. He called a taxi. It would be a 20-minute wait-and a $40 fare.
He arrived at work an hour late, missing an important meeting but showing up just in time to be chewed out by an irate customer.
Joe decided that what he really needed was some coffee, but when reaching over to turn his computer on he knocked his mug over, spilling hot coffee in his lap before it fell to the floor. Bending over to pick up his mug, he again banged his head, this time on the edge of his desk.
His assistant walked into his office with a stack of urgent messages. "Wow!" he said, surveying the disaster. "Bad day?"
"No, it's a great day!" Joe sat up, holding a pen. "I just found my lucky pen!"

Watch for sugar hidden in foods
You know that avoiding sugar is one key to maintaining your weight and your health.
But do you know all the supposedly "healthy" foods that sugar can be hiding in?
Be on the lookout for these hidden sources of unnecessary sugar in your diet:
· Salad dressing. A dressing that's low-fat or fat-free can contain 5-7 grams of sugar per serving. · Flavored yogurt. Yogurt may provide protein, but the fruity varieties often include up to 25 grams of sugar per 6-ounce serving. Buy plain yogurt and add your own fruit instead.
· Pasta sauce. Commercial pasta sauces frequently add sugar as a flavor enhancer. Skip those that list sugar among the first three ingredients.
· Granola bars. Oats, nuts, dried fruits are all good, but the extra sugar added to most granola bars (along with trans fats) can undercut their nutritional value.
